The Plaintiff, a 55-year-old male previously enjoying good health, suffered severe and irreversible harm including injuries to his neck, back, shoulders, legs, and ankles due to a vehicular collision.
At the time of the accident, the Plaintiff was operating a 25-passenger company bus without any passengers onboard. While approaching an on-ramp, a vehicle abruptly merged in front of him, prompting him to apply the bus’s brakes. Consequently, a dump truck trailing the Plaintiff collided with the rear of the bus, propelling it into the vehicle ahead. The force of the collision caused the dump truck, which was laden with sand, to overturn.
As a direct consequence of the incident, the Plaintiff has undergone an anterior cervical discectomy and fusion at the C5-C6 level. This surgery has resulted in reduced mobility at the fused segments, transferring stress to the adjacent discs and necessitating further anterior cervical discectomies and fusions at the C4-C5 and C6-C7 levels. The Plaintiff’s medical provider has indicated that these additional surgeries will be required over the course of his lifetime. Post-surgery, the Plaintiff will require ongoing physical therapy for rehabilitation.
