A 44 year-old cafeteria worker was seriously injured when she slipped and twisted on a wet floor while working. As a result of her injuries, she never returned to work and eventually underwent surgery to her neck and back. The incident was captured on video surveillance. The defense claimed that the woman could not have possibly been injured by the incident, since she never fell to the ground or struck anything with any parts of her body. She appeared to walk away from the scene uninjured. The defense also claimed that she was fully capable of returning to work and that the surgeries were from pre-existing age-related changes and not due to any trauma.
Our firm took an aggressive position and retained five medical, vocational and economic experts to testify on the woman’s behalf at trial. After a failed attempt at mediation, and on the eve of trial, the defense agreed to settle the claim for $375,000. In addition, our lawyers helped negotiate a settlement of the woman’s separate workers compensation claim for a very favorable outcome (also on the eve of trial).
