This case arose out of a 2011 motor vehicle accident in which plaintiffs, husband and wife, were rear-ended by another vehicle. Both plaintiffs sustained disk injuries in their low backs, underwent testing and physical therapy and, ultimately, underwent minimally invasive spinal surgery. The defense denied that plaintiffs injuries were related to the accident and retained medical experts who testified accordingly. Simon & Simon aggressively litigated the case and agreed to a non-binding mediation after the case was trial-ready. The cases settled following a day long mediation for a total of $220,000.
