The Plaintiff, a 37-year-old right-handed female of previously sound health, incurred injuries to her cervical and lumbar regions following a vehicular collision wherein the car she was a passenger in was struck from behind. At the time of the incident, the Plaintiff spouse was operating the vehicle. According to the police report, the defendant has been attributed fault for the mishap. This event resulted in property damages amounting to $6,000 to the 2016 Cadillac Escalade in which the Plaintiff was traveling, though the vehicle remained operational post-accident.
The Plaintiff maintained consciousness throughout the ordeal, with no airbag deployment occurring upon impact. She reports having sustained immediate impacts to her neck, mid-back, lower back, right and left shoulders, and hips at the moment of the collision. Subsequently, she began to experience soreness and pain in these areas. Despite the immediate discomfort, the Plaintiff sought medical attention the following day due to aggravating symptoms, necessitating an evaluation that included radiographic imaging of her lumbar spine.
As a result of the collision, the Plaintiff has been diagnosed with an array of conditions, including Post-traumatic Cervicalgia, Post-traumatic Cervical Facet Syndrome, and disc herniation at the C4-5 and C5-6 levels as evidenced by Magnetic Resonance Imaging (MRI). Additionally, MRI scans have revealed disc bulging at the C3-4, C4-5, C5-6, and C6-7 levels. The Plaintiff also suffers from Post-traumatic Lumbago, Post-traumatic Lumbar Facet Syndrome, and disc bulging at the L1-2, L2-3, L3-4, L4-5, and L5-S1 levels, as well as Myofascial Pain Syndrome, following the incident.
